H1B Process Overview

Here is a general outline of the steps:
A. You must first find a U.S. employer who will sponsor you to fill a specialty position that requires your bachelor’s degree.
B. Then your employer needs to obtain a Labor Condition Application from the Department of Labor.
C. If you or your employer are subject to the annual cap, then your employer must file an I-129 petition with the USCIS during the lottery window.
D. If your petition is selected and approved, then you can choose from two options to acquire your visa:
1. Wait for your employment to start on October 1st. Your status will be automatically adjusted to H1B as soon as you begin working for your sponsoring U.S. employer. This is ideal if you are already in the U.S. under a different nonimmigrant status.
